Controversies on Copyright of AI Paintings

In an art exhibition held in the United States in August, the AI-generated painting called "Theatre D'opera Spatial" won the championship. The artwork was created through an AI program called "Mid journey," which converts textual descriptions into images in seconds.

 

This year, AI programs such as "DALL-E2" and "Imagen" as well as "Mid Journey" were released one after another, making it easy for anyone to draw complex and realistic pictures just by typing in text. As AI began to study art, controversies over this have intensified.

 

Let's start with negative opinions about AI paintings. Some argue that AI artwork is a form of plagiarism disguised as high-tech art. When mining data for AI learning, developers use all the pictures on the Internet. In the end, they use images of existing works. At this time, opponents claim that it will infringe on the copyright of original artwork creators.

 

Objectors say that AI's paintings are ultimately a combination of established works, so the copyright of AI creations should be given to the original authors whose works were used for learning, not to the creators.

 

In contrast, some artists argue that creating works with AI is not much different from using image editing programs such as Photoshop. The Copyright Law also provides copyright infringement immunity that allows users to use materials without requiring permission from the copyright owner through fair use. At this time, the use of data for AI learning is included here.

 

At the same time, he argues that human creativity is also required to come up with appropriate phrases for image conversion. AI creations are not just a combination of data, people need to be creative and careful to get more favorable results. For this reason, some people argue that AI pictures should be copyrighted to creators.

 

To sum up, the negative sides of the AI paintings regard AI paintings as plagiarism. In contrast, the positive sides maintain that AI painting still needs human’s creativity, thus AI painting is acceptable.

 

AI painting still requires human’s creativity, so AI painting can be acceptable. At the same time, however, resources used in AI learning may invade the artists’ copyright. In conclusion, we have to find out the solution about the copyright and use the AI artwork programs properly.
